0. OBJECT AND ACCEPTANCE

These General Conditions regulate the acquisition of the services offered on the website www.elscasals.cat, owned by MASIA ELS CASALS SL (henceforth, ELS CASALS).
The acquisition of any of these services implies the full and unreserved acceptance of all the General Conditions indicated, without prejudice, to the acceptance of the Particular Conditions that may apply when acquiring certain services.
These General Conditions may be modified without prior notification; therefore, it is advisable to read their content carefully before proceeding with the acquisition of any of the services offered.

ELS CASALS, in compliance with Law No. 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce, advises that:

All notifications and communications between users and ELS CASALS will be considered effective, in general, when they are made through any of the means detailed above.

2. PRODUCTS

Available products offered, their general description, and their price, are shown on screen.
ELS CASALS reserves the right to decide, at any time, which products and/or services are available to customers. In this way, ELS CASALS may, at any time, add new products and/or services to those currently offered. Similarly, ELS CASALS reserves the right to withdraw or remove, at any time and without prior notice, any of the products shown.
In order to obtain the different products available from www.elscasals.cat, the user must follow all the instructions indicated in the purchase process, which will entail reading and accepting all the general and particular conditions detailed at www.elscasals.cat.
OBSERVATIONS
Registration is optional for the purchase of the products.

3. PURCHASING AND/OR CONTRACTING PROCESS

To make any purchase from www.elscasals.cat, the customer must be of legal age.
In addition, the client will need to register at www.elscasals.cat through a data collection form which provides ELS CASALS with the necessary legal information; data must invariably be a true, accurate, and complete declaration of the customer’s identity and which the customer must expressly consent to by accepting ELS CASALS’ privacy policy.
In order to complete a purchase, the customer must:
• select the desired product/s;
• select the relevant quantity;
• add it or them to the shopping basket;
• add a message for the recipient (optional);
• review the shopping basket;
• go to checkout;
• enter contact details;
• make the payment;
• confirm the payment;
• receive a confirmation email.

It is also recommended that the customer print and/or save a hard copy of the conditions of sale when placing their order, as well as the emailed proof of receipt from ELS CASALS.

INVOICING
Along with your order, you will receive a corresponding invoice.
The customer consents to receive this invoice in electronic format and may, at any time, revoke this consent electronically in order to receive a paper invoice.

4. DURATION, RENEWAL, AND CANCELLATION OF THE CONTRACT

Until the gift package has been used.

No renewal.

5. DELIVERY OF SERVICES
Electronically:
Immediate delivery upon payment.
The maximum delivery time is 1 day.

6. PRICES, EXPENSES, AND TAXES
The prices of the services listed on www.elscasals.cat is given in Euros unless otherwise stated and will be guaranteed while valid, E&OE, regardless of the order’s destination.

PRODUCTS
The final prices of all products, (and, where applicable, the final prices per unit of measurement, if mandatory) along with their characteristics, offers, discounts, etc., are shown beside each of the items that appear in the catalogue on www.elscasals.cat.
All prices include VAT at a rate of 10%.
Shipping costs: not applicable.
Other additional costs: not applicable.
Product prices may change at any time. The price to be applied will be the one in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the purchase is formally accepted.

7. FORMS OF PAYMENT
We accept these forms of payment:
Credit or debit card
You can make the payment immediately through our Bank’s SSL secure payment gateway. If it is necessary to make any return or cancellation of the order, the amount will be reimbursed through the same card on which the payment was drawn. The confidentiality of both your personal and bank data will be protected by the security measures established in the General Data Protection Regulation (EU 2016/679).
OBSERVATIONS
If payment for a personalized package is to be made via bank transfer, the bank account details will be sent by email once the price of the personalized package has been calculated.

8. RETURNS AND WITHDRAWAL POLICY
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without the need to indicate the reason and without incurring any costs, except those provided for in Art. 107.2 and 108 of RD1/2007, of 16 November 2007, of the General Law for the Defence of Consumers and Users.
This right of withdrawal is not applicable, but not restricted, to:
• Provision of services already completed or in progress.

PRODUCTS
The customer will have a maximum period of 14 calendar days from the day of receipt of the requested goods or product to inform MASIA ELS CASALS of their wish to withdraw from the contract.
Withdrawal implies that MASIA ELS CASALS will refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for his or her payment (as long as the product purchased does not fall within the exceptions indicated above).
During this period, the consumer will notify MASIA ELS CASALS of his or her decision to withdraw from the contract by filling in the form at the end of this document and sending it to MASIA ELS CASALS via email.
MASIA ELS CASALS will give the consumer written proof of receipt of this withdrawal.
To proceed with the return of a product, it is essential that it is in perfect unused condition with its original packaging and all its accessories.
Once we receive your request we will contact you with details of the return procedure.
The customer will bear the costs of returning the goods.

9. CUSTOMER SERVICE AND CLAIMS
To file any complaint or claim with ELS CASALS, the customer must contact the customer service department.
According to the Resolution of online litigation in EU consumer matters and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at http://ec.europa.eu/consumers/odr/.

10. APPLICABLE LEGISLATION
These conditions are governed by current Spanish legislation.
The language used is Spanish.
